1. Taraflar ve Kabul

Bu sözleşme, MYRABT uygulamasını ("Uygulama") kullanan gerçek kişi ("Kullanıcı") ile Uygulamayı geliştiren taraf ("Geliştirici") arasındadır. Uygulamayı kurup "Kabul Et" diyerek bu koşulların tamamını kabul etmiş sayılırsınız. Kabul etmiyorsanız Uygulamayı kullanamazsınız.

2. Hizmetin Tanımı — Noktadan Noktaya Aktarım

MYRABT, Kullanıcının cihazları arasında (ve izin verdiği diğer kullanıcıların cihazlarıyla) fotoğraf, video ve belge gibi dosyaların doğrudan, cihazdan cihaza (peer-to-peer) aktarımını ve yerel yedeklenmesini sağlar. Dosya içerikleri Geliştiricinin sunucusundan geçmez ve sunucuda saklanmaz. Sunucu yalnızca cihazların birbirini bulabilmesi için bir "adres defteri" ve eşleşme onayı işlevi görür.

3. Sunucuda Saklanan Veriler

Geliştiricinin sunucusunda yalnızca şunlar saklanır: kullanıcı adı, e-posta adresi, telefon numarası, şifrenin geri döndürülemez özeti (hash), kullanıcının cihazlarının kimlikleri, eşleşilen cihazların kimlikleri, aylık internet aktarım hacmi ve sürüm (Ücretsiz/Pro) bilgisi. Ayrıca sözleşme onayının tarihi, sürümü ve onay anındaki IP adresi denetim amacıyla saklanır. Şifrenin kendisi hiçbir yerde saklanmaz. İsteğe bağlı düşük çözünürlüklü profil fotoğrafı sunucuda saklanır.

4. Verilerin Sahipliği ve Yedekleme Sorumluluğu

Cihazlarınızdaki tüm veriler size aittir. MYRABT bir bulut yedekleme hizmeti DEĞİLDİR. Verilerinizin güvenliği, birden fazla cihazda kopyasının bulunması ve düzenli eşitlenmesi Kullanıcının sorumluluğundadır. Bir cihazın kaybı, çalınması, arızalanması, biçimlendirilmesi, işletim sistemi hatası, kullanıcı hatası veya başka bir nedenle oluşan veri kayıplarından Geliştirici hiçbir şekilde sorumlu değildir.

5. Geliştiricinin Erişiminin Bulunmaması

Geliştirici, Kullanıcının cihazlarında bulunan dosyalara, medyaya veya klasör içeriklerine hiçbir şekilde erişemez, bunları göremez, kopyalayamaz, değiştiremez veya bunlara müdahale edemez. Aktarım şifreli ve doğrudan taraflar arasındadır.

6. Yasa Dışı İçerik ve Kullanıcı Yükümlülüğü

Kullanıcı, Uygulama aracılığıyla sakladığı, aktardığı veya paylaştığı tüm içeriğin yürürlükteki mevzuata — özellikle 5237 sayılı Türk Ceza Kanunu, 5651 sayılı İnternet Ortamında Yapılan Yayınların Düzenlenmesi Hakkında Kanun, 5846 sayılı Fikir ve Sanat Eserleri Kanunu ve Kullanıcının bulunduğu ülkenin yasalarına — uygun olmasından tek başına ve tamamen sorumludur. Yasa dışı, telif hakkı ihlali içeren veya üçüncü kişilerin haklarını çiğneyen içerik nedeniyle doğacak her türlü hukuki ve cezai sorumluluk Kullanıcıya aittir; Geliştiricinin bu içerikler üzerinde bilgisi, kontrolü veya sorumluluğu yoktur.

7. Kişisel Verilerin Korunması (KVKK / GDPR)

Madde 3'te sayılan kişisel veriler; hesabın oluşturulması ve yönetimi, cihazların eşleştirilmesi, arkadaş araması, hizmet sınırlarının (aktarım kotası) uygulanması ve kötüye kullanımın önlenmesi amaçlarıyla, 6698 sayılı KVKK ve (uygulanabildiği ölçüde) GDPR kapsamında işlenir. Kullanıcı; verilerine erişim, düzeltme ve silinme (hesabın tamamen kaldırılması) talep etme hakkına sahiptir. Silme talebinde hesap, cihaz kayıtları, sayaçlar ve profil fotoğrafı kalıcı olarak kaldırılır.

8. Reklamlar (Google AdMob) — Ücretsiz Sürüm

Ücretsiz sürümde Google AdMob aracılığıyla reklam gösterilir. Google, reklam kişiselleştirme ve ölçümü için reklam kimliği (Advertising ID), yaklaşık konum, cihaz bilgileri gibi verileri kendi Google Gizlilik Politikası uyarınca toplayabilir ve işleyebilir. Reklamsız kullanım için Pro sürüme yükseltebilirsiniz.

9. Uygulama İçi Satın Alma (Pro)

Pro yükseltmesi Google Play (veya ilgili uygulama mağazası) üzerinden satın alınır. Faturalama, yenileme, iptal ve iade işlemleri ilgili mağazanın koşullarına tabidir; Geliştiricinin ödeme bilgilerinize erişimi yoktur.

10. Açık Kaynak Bileşenler ve Lisanslar

MYRABT; Flutter, media_kit, FFmpeg, WebRTC, SQLite, drift ve benzeri açık kaynaklı üçüncü taraf bileşenler içerir. Bu bileşenler kendi lisanslarına (BSD, MIT, Apache-2.0, LGPL vb.) tabidir. Tüm lisans metinlerine uygulama içinden Ayarlar → Uygulama Hakkında → Açık Kaynak Lisansları yolundan ulaşabilirsiniz. Uygulama "olduğu gibi" (as-is) sunulur; belirli bir amaca uygunluk dahil açık veya zımni hiçbir garanti verilmez.

11. Sorumluluğun Sınırlandırılması

Yürürlükteki yasaların izin verdiği azami ölçüde; Geliştirici, Uygulamanın kullanımından veya kullanılamamasından doğan dolaylı, arızi, özel veya sonuçsal zararlardan (veri kaybı, kâr kaybı, iş kesintisi vb.) sorumlu tutulamaz. Geliştiricinin toplam sorumluluğu, Kullanıcının son 12 ayda Uygulama için ödediği tutarla (Ücretsiz sürümde sıfır) sınırlıdır.

12. Hizmetin Sürekliliği

Geliştirici; sunucuyu, eşleştirme hizmetini veya Uygulamayı önceden bildirimde bulunmaksızın değiştirme, askıya alma veya sonlandırma hakkını saklı tutar. Sunucu erişilemez olsa dahi aynı yerel ağdaki (LAN) cihazlar arası aktarım çalışmaya devam edebilir.

13. Sözleşme Değişiklikleri

Bu sözleşme güncellenebilir. Önemli değişikliklerde Uygulama açılışında yeni sürüm onayınıza sunulur; onaylamazsanız Uygulamayı kullanmaya devam edemezsiniz.

14. Uygulanacak Hukuk ve Yetki

Bu sözleşme Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıkların çözümünde Türkiye Cumhuriyeti'nin tüm mahkemeleri ve icra daireleri yetkilidir; tüketici işlemleri bakımından Kullanıcının yerleşim yerindeki tüketici hakem heyetleri ve tüketici mahkemelerinin yetkisi saklıdır.

16. Yürürlük

"Kabul Et" seçeneğine dokunduğunuzda bu sözleşme yürürlüğe girer. "Reddet" seçeneğinde Uygulama kapanır ve kullanılamaz.

Terms of use

1. Parties and Acceptance

This agreement is between the natural person using the MYRABT application (the "App") — the "User" — and the party that develops the App — the "Developer". By installing the App and tapping "Accept", you agree to all of these terms. If you do not accept them, you may not use the App.

2. Description of the Service — Peer-to-Peer Transfer

MYRABT enables the direct, device-to-device (peer-to-peer) transfer and local backup of files such as photos, videos and documents between the User's own devices (and the devices of other users the User has authorised). File contents do not pass through and are not stored on the Developer's server. The server acts only as an "address book" so devices can find one another, and to relay pairing approvals.

3. Data Stored on the Server

The Developer's server stores only the following: username, e-mail address, phone number, an irreversible hash of the password, the identifiers of the User's devices, the identifiers of paired devices, monthly internet transfer volume, and edition (Free/Pro) information. In addition, the date and version of agreement acceptance and the IP address at the time of acceptance are stored for audit purposes. The password itself is never stored anywhere. An optional low-resolution profile photo is stored on the server.

4. Ownership of Data and Backup Responsibility

All data on your devices belongs to you. MYRABT is NOT a cloud backup service. Keeping your data safe, maintaining copies on more than one device and syncing regularly are the User's responsibility. The Developer is not liable in any way for data loss caused by device loss, theft, malfunction, formatting, operating-system error, user error or any other cause.

5. No Developer Access

The Developer cannot in any way access, view, copy, modify or interfere with the files, media or folder contents on the User's devices. Transfers are encrypted and go directly between the parties.

6. Unlawful Content and User Obligations

The User is solely and fully responsible for ensuring that all content stored, transferred or shared through the App complies with applicable law — in particular Turkish Criminal Code No. 5237, Law No. 5651 on the Regulation of Internet Publications, Law No. 5846 on Intellectual and Artistic Works, and the laws of the User's country. All legal and criminal liability arising from unlawful, copyright-infringing content or content that violates third-party rights belongs to the User; the Developer has no knowledge of, control over or responsibility for such content.

7. Protection of Personal Data (KVKK / GDPR)

The personal data listed in Section 3 is processed for the purposes of creating and managing the account, pairing devices, friend search, enforcing service limits (transfer quota) and preventing abuse, under Turkish Law No. 6698 (KVKK) and, to the extent applicable, the GDPR. The User has the right to access and rectify their data and to request erasure (complete removal of the account). Upon an erasure request the account, device records, counters and profile photo are permanently removed.

8. Advertising (Google AdMob) — Free Edition

The Free edition displays advertising through Google AdMob. Google may collect and process data such as the Advertising ID, approximate location and device information for ad personalisation and measurement, under Google's Privacy Policy. Upgrade to Pro for ad-free use.

9. In-App Purchase (Pro)

The Pro upgrade is purchased through Google Play (or the relevant app store). Billing, renewal, cancellation and refunds are subject to that store's terms; the Developer has no access to your payment details.

10. Open-Source Components and Licences

MYRABT includes open-source third-party components such as Flutter, media_kit, FFmpeg, WebRTC, SQLite and drift. These components are subject to their own licences (BSD, MIT, Apache-2.0, LGPL, etc.). All licence texts are available in-app via Settings → About → Open-Source Licences. The App is provided "as is"; no warranty, express or implied, including fitness for a particular purpose, is given.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, special or consequential damages (data loss, lost profits, business interruption, etc.) arising from the use or inability to use the App. The Developer's total liability is limited to the amount the User paid for the App in the last 12 months (zero in the Free edition).

12. Continuity of Service

The Developer reserves the right to modify, suspend or discontinue the server, the pairing service or the App without prior notice. Even if the server is unreachable, transfer between devices on the same local network (LAN) may continue to work.

13. Changes to the Agreement

This agreement may be updated. For material changes, the new version is presented for your approval when the App starts; if you do not approve it, you may not continue using the App.

14. Governing Law and Jurisdiction

This agreement is governed by the law of the Republic of Türkiye. All courts and enforcement offices of the Republic of Türkiye have jurisdiction over disputes; for consumer transactions, the jurisdiction of the consumer arbitration committees and consumer courts at the User's place of residence is reserved.

16. Effect

This agreement takes effect when you tap "Accept". If you tap "Reject", the App closes and cannot be used.
